When you shop with us or use our services, these terms apply. If you need anything else, get in touch with us and we happy to help.
Terms and conditions may be updated with or without notice, so it is important to check back in before you shop, as the latest set will apply.
2. DEFINITIONS
In these Terms and Conditions:
a. "Account" means the SHOP.KIMNSHIN Account that you will need to register on our Platform if you would like to submit an Order;
d. “Order Confirmation" means our email to you, in which we acknowledge your Order;
e. "Contract" means your Order of a Product or Products in accordance with these Terms and Conditions;
f. "Customer" means any individual who places an Order on the Platform;
g. "Order" means the Order submitted by you to the Platform to purchase a Product from us;
h. "“Platform” means SHOP.KIMNSHIN Website;
i. "Website" means the SHOP.KIMNSHIN website accessed at the following address at www.shop.kimnshin.com;
j. "You" means the Customer or a guest;
l. Headings are for ease of reference only and shall not affect the interpretation or construction of the Terms and Conditions;
m. Words imparting the singular shall include the plural and vice versa. Words imparting a gender shall include every gender and references to persons shall include an individual, company, corporation, firm or partnership;
3. ELIGIBILITY
To place an Order with SHOP.KIMNSHIN you must be over eighteen (18) years of age; have a credit or debit card that we accept; and be authorised to use that credit or debit card (e.g. it is in your name or you have permission to use it).
4. PROHIBITIONS (A.K.A. WHAT YOU CANNOT DO)
Of course, you must not misuse our website (e.g. hack, introduce viruses, trojans, worms, logic bombs or other technologically harmful material or carry out denial of service attacks etc) or otherwise mess with our tech or functionality or steal our or our customers’ data. You shall not commit or encourage a criminal offence, or cause annoyance to other users; infringe upon the rights of any other person’s propriety rights; send any unsolicited advertising or promotional material; or attempt to affect the performance or functionality of any computer facilities of or accessed throughout the Platform.
Troublemakers take note: you agree to indemnify, defend and hold harmless SHOP.KIMNSHIN, its directors, employees, agents, and affiliates, from any and all third-party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from your use (or misuse) of this Website or your breach of the Terms and Conditions.
5. PLACING AN ORDER
You shall not misuse the Platform by creating multiple user accounts.
When you place an order, you should receive an acknowledgement e-mail confirming receipt of your order. We then carry out a standard pre-authorisation check to make sure there’s enough money on the card. We only accept your order once payment has been approved and we have debited the payment card (and then the contract is made based on these terms).
6. CANCELLATION POLICY
We understand sometimes you changed your minds after a purchase and you want to get your money back.
Contact us within 30 days of your purchase via our contact form to request for a cancellation. If your request is done within 30 days of your purchase, you will receive the total value of your purchase order. After 30 days of your purchase, or after you have claimed your item from the respective vendor, your purchase is strictly non-refundable under any circumstances. 30 days free cancellation does not apply if you have already claimed your items within 30days of your purchase. Once claimed and used, you cannot apply for a refund.
You shall not misuse the Platform by abusing the 30 days cancellation rule, eg. purchasing multiples items in bulk, then cancelling them and repeat.
7. REFUNDS
We aim to refund you within 14 days of your request for cancellation. If you do not receive it within the time frame, do reach out to us and we are happy to help. After 28 days of your request to cancel, if you do not reach out to us, we will assume that the payment has been received and the transaction is completed.
8. VALIDITY
Each purchase is valid for use up to a year from the date of purchase. One calendar year is defined as twelve consecutive months, eg. from 11 Jan 2020 to 10 Jan 2021.
After you have made your purchase on our website, you may approach the respective vendor to claim for your item within a year. However, it is up to the vendor’s discretions whether to allow or disallow the use after one year period and vendor’s decision is final.
For purchase which require at least one month advanced booking, it is advisable to approach your vendor before the 11th month after your purchase to ensure ample time to receive the product or services.
You have to accept and acknowledge that there is strictly no extension of the validity of the purchased item under any circumstances through SHOP.KIMNSHIN.
9. PRICE
Whilst we make best efforts to ensure that all details, descriptions and prices which appear on this Platform are accurate, there may be instances where errors may occur. If we discover an error in the price of any Products which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your Order at the correct price or cancelling it. If we are unable to contact you, we will treat the Order as cancelled.
Upon completing your purchase on our website, it means you have accepted and acknowledged the price and the terms and conditions stated on the listing associated to your purchased item. If you have any questions regarding the price and the promotional vouchers, do contact us before making a purchase.
Shop and purchase only when you feel comfortable.
10. PROMO CODE
E-gift cards and promotional vouchers must be entered at the check-out page online only. Physical presentation of vouchers to SHOP.KIMNSHIN personnel will not be accepted. Remember, it’s up to you to enter the code at checkout!
Each Promo Code has its own terms, which will be made clear at the time it’s issued to you (e.g. what products, single/multiple use, when it can be used etc).
If you’re given a unique Promo Code that is meant just for you (e.g. loyalty code) please keep it secret and don’t let anyone else use it or abuse it. If we think there is or has been misuse of a Promo Code in any way (e.g. selling it or sharing it with others), we can cancel your Promo Code and/or suspend or even close your account without telling you.
To be fair to everyone, if you have missed the deadline for the use of the Promo Code, we cannot extend it for you.
11. GIFT VOUCHERS
If you have received a gift card or gift voucher, do contact us to know when you can use it. Gift card cannot be used together the Promo Code and it is up to you to decide which is better for your purchase. Gift cards are for one time use only, so try to keep it safe!
12. INTELLECTUAL PROPERTY RIGHTS
SHOP.KIMNSHIN owns or has permission to use the intellectual property rights in its Website and its content. You are not allowed to use any part of the Website for commercial purposes unless you have our express permission.
13. LINKS ON THE SITE
You may link to shop.kimnshin.com as long as that is not-commercial, is fair and legal, and doesn’t damage or take advantage of our reputation.
14. LEGAL STUFFS
We have the right to amend, remove or vary our services and/or any part of the Website (including our Ts&Cs) at any time. All amendments to these Terms and Conditions, including our policies will be posted on our Platform and be effective immediately. Your continued use of the Platform constitutes acceptance of the amended Terms and Conditions.
These terms and our dealings with you are subject to Singapore law and the exclusive jurisdiction of the Singapore courts. All dealings, correspondence and contacts between us shall be made or conducted in the English language.
